Q: 1. While the IFB states “that the Service Provider’s preprinted or standard terms shall not be considered as a part of any resulting Contract,” the IFB also states that all Contracts, Statements, of Work, and/or Service Agreements should be submitted with this response with a handwritten signature and date.” Would PCSD consider an offer which requires the inclusion of the service provider’s standard terms and conditions regarding, among other things, service descriptions and Service Level Agreements? 2. In the exceptions section of the service provider’s response, can the service provider reference provisions from an attached standard agreement as potential replacement language for the provision being excepted?
